Just Arrested in Montgomery County

Most individuals who are arrested in Montgomery County, Maryland are first transported to the Central Processing Unit.There are exceptions.For example, persons arrested for DUI offenses are typically transported to a police station, processed in about one to two hours, and then released from that same station.Also, suspects in criminal cases are sometimes transported to a police station to be interviewed by a detective or arresting officer.This may take several hours.

If the individual was arrested by the Rockville City Police, Gaithersburg Police, Chevy Chase Police, or Takoma Park Police, he or she might be taken to one of those stations.Specific station information is listed at the end of this page.

However, most arrested individuals are transported directly from the crime scene to the Central Processing Unit located at 1307 Seven Locks Rd., Rockville, Maryland 20850 (240-777-9960).There, officers and staff will collect basic biographical and health information.Paperwork for the charges will be prepared.Checks will be made for any outstanding warrants or cases.And the defendant will eventually be taken before a Commissioner who may order the defendant to be released, may set a bond, or may order that the defendant is to be held without bond.This process in Montgomery County typically takes between four and 24 hours.Detained suspects taken before a commissioner will be represented by an Assistant Public Defender who will be able to help the defendant convey whatever information the commissioner is interested in knowing.In our experience, there is very little a privately retained attorney can say or do at this stage that the Assistant Public Defender cannot do, and it is possible the defendant’s release can be delayed if the commissioner decides to wait for the the private attorney to be available.However, if the commissioner does not allow the defendant to be released, a privately retained attorney can be very helpful for any bond review that is held in the District or Circuit Court the next business day, usually at 1:00 p.m. If you would like have representation by one of our attorneys, please call us at (301) 251-9001.

There are some things you should be thinking about if a friend or family member has been arrested.First, in most cases, you wil want to secure the release of the defendant. ( https://mdcourts.gov/district/arrested#bail )Be aware that money you pay to a bondsman is not refundable, money that you post to the Court is returned once the case is over.Bonds set by a commissioner are frequently adjusted to more appropriate terms at a bond review before a judge the next business day.So, it may be important to have an attorney at the bond review hearing who can address bond concerns the judge and the prosecutor will have.For purposes of release, it is important to be able to identify the address, phone number, and residents of the place where the defendant will live if released from jail.Especially in cases involving crimes of violence, burglary, domestic violence, and destruction of property, the defendant will likely not be permitted to return to the place where the crime occurred (while the case is pending) even if it allegedly occurred at his own home.

If the defendant has a warrant pending from another case, or an immigration detainer, he may not be released even if you pay or post the bond.

If you think the defendant may not have a place to live, may reoffend if immediately released, or may be in need of mental health services, you may want to speak to an attorney about postponing the bond review hearing a few days until safe and satisfactory conditions are in place.If the first bond review goes forward and the defendant is denied a bond, it may take weeks to get another bond review hearing.
